Oz Servers owners battle in court amid legal standoff

A disagreement between the two former owners of Oz Servers over the ownership of the Brisbane-based hosting provider is stuck in court.

Court documents show a litany of accusations made by former director Sean Finn against managing director Harry Hoholis, largely focused on the misuse of company finances and allegedly transferring Finn's shares without his consent.

Cracks in the relationship began in 2011 when Finn claimed that Hoholis withdrew $60,000 from the business without his consent to purchase personal property.

Hoholis claimed the withdrawal had been discussed and authorised by Finn and was used to help Hoholis relocate to Brisbane to take a more hands-on role in the business.

Finn also alleged that Hoholis had commandeered Oz Servers staff and 40 servers to operate a side business. Hoholis said that an agreement had been made whereby the side business was allowed to utilise the staff and servers in return for not charging interest on a loan.

Central to the dispute is Finn's claim that his former partner had unlawfully transferred shares, diluting Finn's ownership of the business. Finn claims to own 40 percent of Oz Servers.

As the plaintiff, Finn is seeking that Oz Servers records be adjusted to reflect that he is entitled to his 40 percent stake, and that the company be wound up.

Hoholis has largely denied the allegations, saying the events either did not occur or that Finn wasn't in an acceptable position to take responsibility of the business.

The case has been held up in the courts, with no clear date for when it will go to trial.
