Melbourne satellite broadband reseller Activ8me has copped a fined for allegedly making false representations about endorsements from the Australian Competition and Consumer Commission.
The telco, which sells satellite internet services via NBN Co's Sky Muster satellite, wrote on its website and Facebook page that the ACCC had named it the "#1 Sky Muster provider".
The claim stemmed from the ACCC's quarterly NBN wholesale market indicators report released in November, which listed Activ8me as having the largest satellite services in operation. The ACCC said it did not endorse or approve ACtiv8me over any other telco.
Activ8me also used the ACCC logo in close proximity to its own marketing.
“The ACCC does not endorse or approve particular businesses and it is imperative that consumers trust our name and logo when it is used,” said ACCC commissioner Sarah Court.
“As soon as we became aware of the misuse of our report findings and logo, we contacted Activ8me and issued an infringement notice. Activ8me has since removed the representations. This penalty serves as a warning to companies that we will act swiftly if they misrepresent the ACCC.”
Activ8me paid a $12,600 penalty for the alleged infringement, though the ACCC noted that the payment of a penalty isn't an admission of contravening Australian Consumer Law.
