Apple is facing a class action law suit for replacing customer's devices with refurbished models under AppleCare Plus.
Under the terms of the AppleCare contract, the vendor promises to replace an accidentally damaged device with replacement that is "equivalent to new in performance and reliability". The case hinges on whether that definition includes refurbished devices.
The suit was filed in California by an Apple customer, Vicky Maldonado, who said she received a refurbished iPad twice under two separate AppleCare Plus contracts.
Court documents do not explicitly explain what was wrong with the refurbished devices, but Maldonado claims they are not equivalent to new in performance and reliability.
The plantiffs are seeking a court injunction to stop Apple from its replacing damaged devices with refurbished products, changes to AppleCare's terms and conditions, along with restitution.
AppleCare Plus costs $129 in Australia and offers two incidents of accidental damage coverage for two years, along with technical support.
