The ACCC instituted legal proceedings in the Federal Court, on July 12 2007 against Trading Post Australia, Google Inc, Google Ireland and Google Australia alleging misleading and deceptive conduct in sponsored links that appeared on the Google website.
According to the ACCC, at yesterday’s hearing the case against Google Ireland and Google Australia, would be discontinued on the basis of submissions by Google Inc that it is responsible for all representations made on www.google.com.au.
After confirming this position, the ACCC agreed any outcome against Google Inc would necessarily be put into effect in Australia.
The ACCC will now file and serve amended pleadings by 25 October 2007.
A Google Australia spokesperson said Google has no further comments on the new developments but as previously stated will continue to fight the allegations.
