DTA seeks input on end user license agreements for new software and cloud module

The Digital Transformation Agency is requesting feedback on proposed end user license agreements (EULAs) as it works to add a new software and cloud module to the Digital Marketplace Panel 2.

DTA wants the feedback on the EULAs to make sourcing faster for both buyers and sellers, as well as to reduce the need for extensive negotations and legal advice.

"Our goal is to protect the interests of both buyers and sellers, ensuring that all transactions are conducted smoothly and securely," Peter Rymasz, a director in the DTA's Digital Sourcing Branch said.

The Digital Marketplace Panel 2 currently offers two modules: ICT labour hire and professional and consulting services.

During research conducted for the Digital Marketplace Panel 2 project, as well as surveys across the DTA's Software and Cloud Marketplaces, users indicated that multiple panels could lead to duplicate effort and inconsistency in the procurement process.

Streamlining procurement paths for easier buying was also emphasised by users who said the line between software and cloud products had become increasingly blurred.

This suggested a need to combine the panel for software and cloud products into a single arrangement, DTA said.

"Buyers can sometimes find it challenging to navigate the numerous categories available under the cloud and software marketplace," Rymasz said.

"Procurement officers may not possess the in-depth product knowledge that would help them to identify the right category to approach."

Rymasz said the DTA has an opportunity now to develop broader categories that are more aligned with market needs.

Until the new module is available, DTA said the current cloud and software marketplaces will continue to operate as usual. 

DTA hopes to have the new software and cloud module available by late 2026.
